Prakash Bom - 7/6/2008 It is off course the action of Minister Yadav for locking up government employee is undemocratic because first off all it violates government's code of conduct and employee's civil liberty and right for justice.
But what local development officer Dundu Raj Ghimire has done against the will of people of Devichoar, Lalitpur regarding community forest is the issue. In democracy people's will is the primary consideration for government to take into account for any government plan and program to expedite. Basically, government cannot enforce its plans and programs without the pole or vote of the local community. That's why people have declared Nepal a federal democratic republic because they want to put an end to the power of government officers in every level of the government.
The ministry of forest and conservation must take action against LDO Dundu Raj Ghimire because he has forced operation of quarry in the community forest against the will of the local people. Government officers who are corrupt and addicted with the power of previous governments' administration must change their attitude that no government authority can force plans and program in the vicinity of the local communities against the will of people prior to their vote or consultation. If they did then both people's government and local people must take the action against such authoritarian government employees.
Government employees must not have immunity for misusing their authority and committing corruptions under the federal democratic republic of Nepal. They must be accountable for their misconduct and corruption an individual employee of the government.
Therefore, the government must take action against Dundi Raj Ghimire who has as a LDO of Lalitput has outright disregarded the will of the people of Devichoar and violated the right of the community forest.
Then only after the government can ask minister Yadav for explanation. Since Nepal is in transition period both LDO and minister have failed with their compliance to norms and principle of democracy.
It is irresponsible of the civil servant union if it without second thought rushes to protect against the minister such as Yadav and in support of corrupt civil servant or government employee such as LDO Ghimire who has forced operation against the will of the people of the community forest.
How government employees such as LDO Ghimire do not take their responsibility in protecting people's civil liberty and right in the local level administration and law enforcement can with evidence be proved with the following current evidence:
An eighteen girl has been accused of witchcraft and was paraded naked in Ramchhe Bazaar village yesterday by the young men of the village for not fulfilling their demand. The local government employees did nothing until the victim had filed the case in the local police depot. Social crimes such as are committed in the local lives of people every day yet LDO such as Ghimire refrain from it getting busy in corruptions.
All contemporary government officers must change their old administrative attitude and learn to respect people's will in their local residence and maintain promptly law enforcement to control social crimes such as mentioned above. The people's representatives in government bodies must legislate to regulate the government employees as per the new establishment. If not there will be frequent clash occurring between people's representatives and government employees such as between the minister Yadav and LDO Ghimire.
